Jap’On Demande offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.  

By visiting our site and/ or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.  

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools added to the current store will also be subject to the Terms of Service. You can review the most recent version of the Terms of Use at any time on this page. We reserve the right to update, modify, or replace any part of these Terms of Service by posting updates and/or changes on our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.  

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.  

ARTICLE 1 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and have given your consent to allow any of your minor dependents to use this site.  

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).  

You must not transmit any worms, viruses, or code of a destructive nature.  

A breach or violation of any of the Terms will result in immediate termination of your Services.  

ARTICLE 2 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (excluding credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform to and adapt to the technical requirements of connecting networks or devices. Credit card information is always encrypted when transferred over networks.  

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission from us.  

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.  

ARTICLE 3 - ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. Any reliance on the material on this site is at your own risk.

ARTICLE 4 - CHANGES TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice.

We reserve the right to modify or discontinue the Service (or any part or content thereof) at any time without notice.  

We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.  

Prices are based on the Japanese market rate. Should the purchase price decrease within twenty-four (24) hours following the order date, please contact us for a price adjustment. Any price adjustment requests received beyond this timeframe cannot be considered due to market fluctuations.

Shipping costs are estimated based on the information provided by the manufacturer. Jap'On Demande reserves the right to charge the customer for any price difference resulting from inaccurate information. Any excess amount collected for shipping costs will be refunded.

Shipping Costs and Dimensions Adjustment: In the event that a product's actual dimensions exceed those initially provided by the manufacturer, resulting in additional shipping costs, Jap’On Demande will inform the customer. Should the customer refuse to pay the price difference for shipping, the company reserves the right to ship the order using the most economical method available (surface/sea mail) and to remove the original packaging (shipping without the box) to reduce volume and costs.

If the shipping costs are deemed excessive and no viable transport solution exists without the payment of the balance, the product will not be shipped until the customer has settled the outstanding amount. Failure to pay within 30 days entitles the company to reserve the right to resell the product. Once the resale is finalized, the customer will be refunded the initial amount, minus storage fees, administrative management fees (20% of the product price), and any loss in value incurred during the resale.

ARTICLE 5 - PRODUCTS OR SERVICES

Order Processing Times
All orders are generally processed within a standard timeframe of five to ten business days (Monday to Friday), starting from the validation of the payment. In the event of exceptional circumstances—such as the release of rare products, high-demand items (temporary out-of-stock situations), or during peak periods (end-of-year holidays, specific promotions)—this processing time may be extended to a maximum of fifteen business days. Please note that orders are not processed on weekends or public holidays observed in Japan, our primary place of business.

Certain products or services may be available exclusively online through the website. These items may have limited quantities and are subject to return or exchange only in accordance with our Return Policy. We have made every effort to display as accurately as possible the colors and images of our products as they appear in-store. However, we cannot guarantee that your computer monitor's display of any color will be perfectly accurate.

We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. Regarding collectible cards, unless otherwise stated, items are not pre-certified (e.g., PSA 10) and may exhibit minor handling or manufacturing flaws that may have escaped our inspection; the buyer therefore accepts the product "as is."

ARTICLE 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders using the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.

ARTICLE 7 - OPTIONAL TOOLS

We may provide you with access to third-party tools that we do not monitor, control, or input.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.  

Any use by you of optional tools offered through the site is entirely at your own risk and discretion. You should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).  

Any misuse of the optional tools may result in the cancellation of the order(s), and in the worst case, lead to a ban from the site.

We may also, in the future, offer new services and/or features through the Website (including the release of new tools and resources). Such new features and/or services will also be subject to these Terms of Use.

Certain content, products, and services available through our Service may include materials from third parties.

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of these third-party websites and do not warrant or assume any liability or responsibility for any third-party materials, websites, or other materials, products, or services.  

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please carefully review the third-party policies and practices before engaging in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.

If, at our request, you send certain specific submissions (for example, contest entries) or without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, "Comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use any Comments you send to us. We may, but have no obligation to, monitor, edit, or remove content that we determine, in our sole discretion, is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party's intellectual property or these Terms of Use.

You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality, or other personal or proprietary rights. You further agree that your comments will not contain libelous or otherwise unlawful, abusive, or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for the comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.

Your submission of personal information through the Store is governed by our Privacy Policy.

Occasionally, there may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).  

We undertake no obligation to update, amend, or clarify information in the, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on has been modified or updated.

ARTICLE 12 - PROHIBITED USES

We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free.

We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.  

You agree that from time to time, we may remove the Service for indefinite periods or cancel the Service at any time, without notice.  

You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and services delivered to you through the Service are (except as expressly stated by us) provided "as is" and "as available" for your use, without any representations, warranties, or conditions of any kind whatsoever, express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Under no circumstances will Jap'On Demande, our directors, officers, employees, affiliates, agents, subcontractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, lost data, costs of replacement, or similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising out of your use of any of the services or any products purchased using the service, or for any other claim relating in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of whatsoever arising from the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of the possibility thereof. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

ARTICLE 14 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Jap'On Demande and our parent company, subsidiaries, affiliates, partners, officers, directors, agents, subcontractors, licensors, licensees, service providers, contractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your violation of these Terms of Use or the documents they refer to, or your violation of any law or the rights of a third party.

ARTICLE 15 - SEVERABILITY

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions

ARTICLE 16 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this Agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Use at any time by notifying us that you no longer wish to use our Services or when you cease using our Site.  

If, in our sole judgment, you fail to comply with any term or provision of these Terms of Service, we may also terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination; and/or we may deny you access to our Services (or any part thereof).

ARTICLE 17 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.  

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Use).  

Any ambiguity in the interpretation of these Terms of Use shall not be construed against the drafting party.

ARTICLE 18 - GOVERNING LAW

These Terms of Use and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of 3-5-39 Maezawa Forest Maezawa A-3 Higashikurume-Shi JP 2030032, with the exclusive jurisdiction of the Tokyo courts, Japan.

ARTICLE 22 - CUSTOMS TAXES

For orders under €150 via FedEx in Europe:
Taxes are calculated on our site, and you pay them directly on the site! We handle tax collection.

For orders over €150:
Taxes are not calculated on our site. The carrier will ask you to pay them once your order arrives in Europe. You will receive an email with instructions on how to proceed.

These taxes are independent of our company and are required by the country where you receive your order.

For orders under €150 via FedEx in Europe:
The Import Single Window (IOSS) was created to simplify the declaration and payment of VAT for distance sales of imported goods with a value not exceeding €150 excluding shipping costs. In this case, taxes are calculated on our site before placing the order. When you place your order, VAT is then included only with FedEx, and we are responsible for collecting it.

For orders over €150:
If the total amount of your order exceeds €150, excluding shipping costs, VAT will not appear on our site and will not be calculated or paid on our site!

Customs Taxes and Duties: For orders exceeding €150, you, the buyer, are considered the importer and are responsible for any applicable taxes and duties upon delivery by the carrier. These fees are separate from our purchase price and are not calculated on our website.
Buyer Responsibility: It is recommended that you familiarize yourself with import regulations in your country before placing an order. Jap'On Demande is not liable for any customs fees, VAT, or administrative fees associated with your order.

ARTICLE 23 - RETURN OF PACKAGES FOR ABSENCE OR REFUSAL

If your package is returned to Japan due to your absence, Jap'On Demande will be charged return costs. If you wish to have your package resent, you will then be charged return costs plus new shipping costs.

A returned or refused package (due to absence, taxes, change of mind, or any other reason) is not eligible for a refund.

ARTICLE 24 - CANCELLATION POLICY

In-Stock Items
Generally, once your order has been placed, it cannot be canceled. However, in certain special circumstances, a cancellation may be considered, subject to 20%-30% restocking fee, with a minimum of 10 euros deducted from the value of your ordered items. Jap’On Demande reserves the right to decide on a case-by-case basis whether or not to accept a cancellation request.You can send your requests to the following address: savjapondemande@gmail.com

If you decide to use a third-party service or dispute the charge to obtain a refund for an order, you will be blacklisted and will no longer be authorized to use the site.
Please note that orders that have already been shipped cannot be canceled. Customers wishing to return a shipped order are invited to consult our return policy for more information.

If an order contains multiple items and one item is out of stock, the order cannot be canceled. It will be shipped with the available items, a refund will be issued for the missing item, and shipping costs will be adjusted accordingly.

Pre-Ordered Items

Pre-orders canceled up to 7 days before the release date will be subject to a 30% cancellation fee of the item's price, with a minimum of 10 euros, for the orders valued under 250 euros.

Beyond this deadline, cancellations will be subject to 30%-50% cancellation fee of the price of the pre-ordered items, with a minimum of 15 euros, for the orders under valued 250 euros.

Please note that free cancellations cannot be granted for delayed release dates.
Pre-orders for orders exceeding 250 euros cannot be canceled and are therefore non-refundable.

If an order contains multiple items and one item is out of stock, the order cannot be canceled. It will be shipped with the available items, a refund will be issued for the missing item, and shipping costs will be adjusted accordingly.

ARTICLE 25 - SHIPPING INSURANCE

Jap'On Demande offers you the option to purchase Shipping Insurance at checkout to protect your package during delivery.

In the unlikely event that your package is damaged, lost, or stolen, your order will be insured for a replacement or refund, at Jap'On Demande's discretion.

Shipping Insurance will cover cases of damaged, lost, or stolen packages that occur during transit from our warehouse to your shipping address.

Damaged package: an item has visible damage that occurred during shipping, such as broken parts or paint scratches. Damages must be reported to the local postal carrier.

Loss: the package was stolen before or during delivery. Please note that a police report must be filed when filing a theft claim.

Jap'On Demande cannot cover thefts in cases of signature upon delivery.
Jap'On Demande will handle theft cases after receipt of the package against signature on a case-by-case basis depending on the results of the police investigation.
Jap'On Demande cannot cover thefts or losses when using a third-party service such as Mondial Relay.
Jap'On Demande is not liable for theft or loss via Small Packet, pursuant to the Japanese legal change of March 1, 2026.

In the absence of subscribing to Shipping Insurance, the customer explicitly and irrevocably agrees to assume all risks of loss, theft, or damage to the package occurring during transit. In such a case, Jap'On Demande disclaims all liability and will not be required to provide a replacement, refund, or compensation for the order.
The customer acknowledges that the choice not to subscribe to insurance implies a waiver of any recourse against Jap'On Demande for these shipping incidents, subject to the mandatory provisions of applicable law that cannot be excluded by contract.

ARTICLE 26 - INVOICING

Jap’On Demande primarily caters to individual customers, and as such, we do not automatically issue a formal invoice after each purchase. Your order confirmation sent via email and your bank statement serve as sufficient proof of purchase.

Should a customer require a tax invoice for their business, it is essential that the purchase is settled using a corporate credit card, and that the company's email address along with its Consumption Tax registration number (TVA/JCT registration number) are provided at the time of order placement. No corporate tax invoice can be issued retrospectively if these conditions are not met during the transaction.

ARTICLE 27 - CUSTOMER CONDUCT AND AFTER-SALES SERVICES

Any behavior on the part of the Customer deemed to constitute harassment, insults, threats, verbal abuse, sending abusive, repetitive messages, or other forms of unjustified pressure (including on social media and other public or private communication platforms) towards our After-Sales Service team members or our company is strictly prohibited.

Consequences of Harassment
In the event of a proven breach of the courtesy and respect rule stated above, and after assessment of the severity of the behavior by our Company:
No Response: The After-Sales Service reserves the right to interrupt all communication with the Client concerned without prior notice.
Order Cancellation and/or Service Suspension: Jap'On Demande may, in the event of a serious breach and unilaterally, proceed with the cancellation of any current order (with reimbursement of the amounts paid where applicable, in accordance with the law) and/or the blocking of the Client's access to their account or their banning from the platform. This measure will be taken after review of the file and will be notified to the Client.
Blocking of Communications in Case of Attempted Fraud or Abuse: Voluntary harassment with the proven goal of obtaining a refund, exchange, or any other commercial advantage through coercion or intimidation will be treated as an attempted abuse or fraud. In this specific case, Jap'On Demande reserves the right to ignore communications from the Client concerned and to block all communication addresses used (email, messaging, etc.).

The application of this clause shall under no circumstances prejudice the Client's legal rights, notably their right to the legal guarantee of conformity.

ARTICLE 28 - LEGAL STATUS SMALL PACKET

The international delivery service "Small Packet" (Kokusai Tokutei Kiroku / 国際特定記録), offered on our website as a budget shipping option, is subject to a strict legal and legislative framework that excludes any possibility of compensation or investigation by our company in the event of loss, tampering, or theft.

-In accordance with the commercial regulations of Japan Post, validated by the Ministry of Internal Affairs and Communications of Japan, the simplified tracking "Small Packet" service is a low-cost service governed by the treaties of the Universal Postal Union (UPU). Japan Post’s official terms and conditions explicitly state for this shipping category: 「調査請求は取り扱わない」 ("Inquiries/investigations are not handled"). From a strictly legal standpoint, this disclaimer of liability is absolute. Once the parcel is transferred to the foreign carrier, the shipper is legally and logistically unable to file a claim, initiate a postal investigation, or demand compensation from Tokyo.

-By selecting the "Small Packet" economic shipping method, the buyer tacitly and knowingly accepts the inherent risks associated with the absence of insurance and the lack of investigation rights, in exchange for a reduced shipping rate.

<!>The Small Packet service is strictly excluded from the coverage provided by our "Shipping Protection". No refund, merchandise replacement, or financial compensation will be granted by Jap’On Demande in the event of non-receipt of a parcel sent via this service.

-Pursuant to the provisions of the Civil Code of the destination country relating to the transfer of ownership (notably the French Civil Code for France), as soon as the international tracking system indicates that the parcel has entered the territory of the destination country (for example, upon the first scan by the national carrier, such as La Poste in France), the buyer legally becomes the owner of the goods.

-If the parcel is misplaced, blocked, or stolen during local distribution, the material loss occurs on the recipient's domestic soil. It is therefore the exclusive responsibility of the customer to take legal or administrative action within their own country (within the European Union):

-With the national carrier, by holding the local delivery service provider (e.g., La Poste, Correos, etc.) liable for breach of its delivery obligations or misconduct in its routing mission.
-With mediation bodies, by filing a free dispute with the competent Consumer Ombudsman in their EU member state (for example, Le Médiateur du groupe La Poste in France), enclosing the tracking history and this contractual clause demonstrating the transfer of ownership and the legal impossibility for the Japanese shipper to intervene in a foreign postal network.
